In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

MEDICAL DISCLAIMER (CRITICAL)The Service Does Not Provide Veterinary Medical Advice:The contents of the “Be A Better Pup” website and application, such as text, graphics, images, caloric calculations, meal recommendations, and other material included with the Service (“Content”) are for informational purposes only. The Content is not intended to be a substitute for professional nutritional or veterinary advice, diagnosis, or treatment.
  • Always Seek Professional Advice: Always seek the advice of your veterinarian or other qualified animal health provider with any questions you may have regarding a medical condition, dietary change, or weight-management plan.
  • No Delay: Never disregard professional veterinary advice or delay in seeking it because of something you have read on the Service.
  • Emergency: If you think your pet has a medical emergency, call your veterinarian or an emergency animal hospital immediately.   1. ACCURACY OF CALCULATIONS & DATAThe Service provides tools (such as calorie calculators and meal configurators) that generate estimates based on standard veterinary formulas (e.g., Resting Energy Requirement).
  • Estimates Only: You acknowledge that these figures are estimates only. Every dog is unique. Factors such as metabolism, age, breed, neuter status, activity level, and underlying health conditions significantly affect actual dietary needs.
  • User Responsibility: You are solely responsible for the accuracy of the data you input (including but not limited to weight, age, and activity level). Inaccurate input data will result in inaccurate recommendations.
  • Monitoring: You agree to monitor your dog’s weight and body condition regularly and adjust their diet as necessary in consultation with your veterinarian. We are not responsible for weight gain, weight loss, or nutrient deficiencies resulting from the use of these calculators.

LIMITATION OF LIABILITYIn no event shall “Be A Better Pup,” its owners, potential partners, or contributors be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Service or the Content, whether based on warranty, contract, tort, or any other legal theory.

NO VETERINARY-CLIENT RELATIONSHIPUse of the Service does not establish a veterinarian-client-patient relationship between you and/or your pet and “Be A Better Pup.” Any communication with the Service or its support team is for informational and technical support purposes only and does not constitute veterinary care.

INDEMNIFICATIONYou agree to defend, indemnify, and hold us harmless from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, arising or resulting from your breach of these Terms of Service or your access to, use, or misuse of the Content or Service.
  4. TERMINATIONWe reserve the right to terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.

ADDENDUM TO TERMS OF SERVICE: APPLICATION & E-COMMERCE

This Addendum (“Addendum”) supplements the existing Terms of Service & Medical Disclaimer for Be A Better Pup (“Company”, “We”, “Us”, or “Our”). By accessing the tracker application (the “Application”) or purchasing merchandise from Our website, You agree to be bound by these additional terms.

1. Application Terms of Use

  • License to Use: The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with these Terms.

  • Accuracy of Information: The Application is provided as a supplementary tool for tracking pet metrics and activities. We do not warrant the absolute accuracy, completeness, or reliability of any tracking data. All metrics, including but not limited to activity levels, behavioral tracking, and feeding schedules, are estimates.

  • Medical Disclaimer Reiteration: The Application is not a substitute for professional veterinary advice, diagnosis, or treatment. You remain solely responsible for monitoring Your pet’s health and consulting a qualified veterinarian for any medical concerns.

  • User-Generated Content: You retain ownership of any data or profiles You input into the Application. However, by entering this data, You grant the Company a license to use, store, and process it to provide and improve the Application’s functionality.

2. Merchandise and Print-on-Demand E-Commerce

  • Order Processing and Fulfillment: Merchandise offered on Our Website is fulfilled through third-party print-on-demand service providers. By placing an order, You acknowledge that Your shipping and order details will be shared with these partners solely for the purpose of fulfilling Your purchase.

  • Shipping and Delivery: Delivery times are estimates provided by Our third-party fulfillment partners and shipping carriers. We are not liable for delays caused by the carrier, customs clearance, or other factors outside Our direct control.

  • Returns and Refunds: Because Our merchandise is created on-demand specifically for Your order, We cannot offer returns or exchanges for buyer’s remorse or sizing issues.
